SAY IT FOR ME provides professional communication services to individuals and businesses who require assistance communicating difficult, sensitive or uncomfortable messages.

Our role is to help communicate a decision or message that the customer has already made.

SAY IT FOR ME does not make decisions on behalf of customers.

We are not a law firm, legal service, counselling service, debt collection agency, employment agency or substitute for professional HR, legal, medical or psychological advice.

2. Our Services

Services may include:

• written messages;

• voice messages;

• telephone calls;

• difficult-conversation assistance; and

• other communication services agreed with the customer.

The exact service, price and scope will be confirmed before the service is provided.

We reserve the right to decline a request where we reasonably believe the requested communication may be unlawful, threatening, abusive, misleading, defamatory, fraudulent or otherwise inappropriate.

3. Customer Responsibility

The customer is responsible for:

• providing accurate information;

• providing sufficient information for us to understand the situation;

• ensuring that they have the authority to instruct us;

• ensuring that the underlying decision or instruction is lawful;

• reviewing and approving the proposed communication before delivery; and

• informing us of any material circumstances that could affect how the communication should be delivered.

SAY IT FOR ME does not independently verify the customer’s allegations, instructions or decisions unless this has specifically been agreed as part of a separate service.

4. Customer Approval

Before we deliver a communication, the customer may be required to approve the final wording, message or proposed approach.

Once the customer has approved the communication, the customer authorises SAY IT FOR ME to deliver it substantially in the approved form.

Where appropriate, we may retain evidence of the customer’s instruction and approval for record-keeping and dispute-resolution purposes.

This is particularly important for business and employment-related communications.

5. Business and Employment Communications

Businesses remain responsible for their employment, contractual and commercial decisions.

SAY IT FOR ME may communicate a decision that has already been made by an appropriately authorised person.

We do not make disciplinary, dismissal, retrenchment, legal or other employment decisions on behalf of businesses.

Businesses should obtain appropriate HR and/or legal advice where required.

6. Prohibited Requests

SAY IT FOR ME will not knowingly provide services involving:

• threats or intimidation;

• harassment;

• stalking;

• coercive or abusive behaviour;

• revenge campaigns;

• impersonation or fraudulent representation;

• knowingly false or deceptive statements;

• defamatory communications;

• facilitating illegal activity;

• extortion or blackmail;

• communications intended to cause unlawful harm; or

• any other communication that we reasonably consider unsafe or inappropriate.

We may refuse or terminate a service where circumstances change, or information provided to us proves materially different from the original instruction.

7. Confidentiality

We understand that customers may provide highly personal, sensitive or commercially confidential information.

We will take reasonable steps to keep customer information confidential and to restrict access to people who need it to provide the service or operate the business.

However, confidentiality does not mean that information can never be disclosed. Disclosure may be required where permitted or required by law, court order, regulatory requirement, or where necessary to protect the rights, safety or property of SAY IT FOR ME or another person.

8. Personal Information

SAY IT FOR ME may collect and process personal information in order to provide its services.

This may include information relating to the customer and, where supplied by the customer, information about other individuals involved in the communication.

Personal information will be processed in accordance with applicable South African privacy legislation and our Privacy Policy.

POPIA establishes conditions for lawful processing of personal information, so this section should ultimately sit alongside a proper Privacy Policy rather than trying to make the Terms & Conditions do all the work.

9. Telephone Calls and Recording

SAY IT FOR ME does not automatically record telephone calls.

Where recording is proposed, SAY IT FOR ME will take appropriate steps to ensure that the recording is handled in accordance with applicable law.

10. Payment

Payment must be made using the payment method made available by SAY IT FOR ME.

Prices displayed on the website are subject to change, but the price applicable to an accepted order will be communicated to the customer before payment.

Additional services or changes to the scope of an agreed service may incur additional charges.

11. Cancellations and Refunds

Because our services may involve customised preparation and communication, cancellation and refund rights may depend on whether work has already commenced and whether the communication has already been delivered.

Our refund and cancellation policy will be made available to customers before purchase.

Nothing in these Terms & Conditions is intended to remove or restrict any consumer right that cannot lawfully be excluded or limited under South African law.

12. Service Delivery

We will make reasonable efforts to deliver the service within the agreed timeframe.

We cannot guarantee that the recipient:

• will answer a telephone call;

• will read a message;

• will listen to a voice message;

• will respond;

• will agree with the communication; or

• will react in a particular way.

Our responsibility is to deliver the agreed communication, not to control the recipient’s response.

13. No Guarantee of Outcome

SAY IT FOR ME cannot guarantee a particular outcome from a communication.

For example, we cannot guarantee that:

• a customer will pay an invoice;

• an employee will accept a decision;

• a relationship will end amicably;

• a recipient will respond positively; or

• a dispute will be resolved.

We provide communication assistance, not guaranteed outcomes.

14. Limitation of Liability

To the extent permitted by South African law, SAY IT FOR ME will not be liable for indirect, consequential or unforeseeable losses arising from the recipient’s reaction to a communication or from a decision made by the customer.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

15. Our Right to Refuse a Service

We reserve the right to refuse a request before delivery where we reasonably believe that:

• the request is unlawful;

• the customer lacks authority;

• the communication presents an unreasonable safety risk;

• the request breaches these Terms & Conditions; or

• providing the service could expose SAY IT FOR ME to significant legal or reputational risk.

Where appropriate, we may refund an amount paid for a service that we decline to provide, subject to our refund policy and applicable law.

16. Intellectual Property

The SAY IT FOR ME name, branding, website, logos, written content, design and other original materials remain the property of SAY IT FOR ME or its respective licensors.

Customers may not reproduce or commercially exploit our branding or materials without permission.
